"The individual driving the vehicle has been charged under Nathan's law for passing a stopped school bus with an injury to a child."
Nathan's Law is named for Nathan Key of Jones County.
Nathan was 5 when he was hit and killed by a driver who passed a stopped school bus in 2009.
"It's a new statute. If injuring a child results, they'll be charged with aggravated assault."
Columbia Police Detective Clint McMurry says it's a warning to all drivers.
"You don't have to knowingly violate the law. Under most statutes you have to willingly and knowingly violate a law to be in violation of that. With Nathan's Law you don't have to willingly or knowingly do it. So just the fact that you overtake or pass a stopped school bus, even unintentionally is still illegal. So I advise drivers to be very careful around children. Around school buses. Because as you now see, these laws have teeth to them that can bite."
